The judge overseeing the Fulton County criminal election interference case against Donald Trump and his allies recently dismissed 3 counts from the indictment, but left the 32 remaining counts intact.
The charges in the case revolve around Trump and co-defendants’ alleged efforts to overturn the results of the 2020 presidential election in Georgia. Judge Scott McAfee determined that the majority of the indictment remains intact.. He dropped two counts against Trump and one count against co-defendants John Eastman and Shawn Still. Judge McAfee dismissed these charges based on the reasoning that state prosecutors did not have authority to bring charges based on false statements and filing of false documents committed in federal court. The charges were dismissed because they were filed in state court but pertain to federal court issues and federal court sanctions already apply.
Trump still faces several criminal counts in the case, including racketeering under Georgia’s RICO statute. Trump has pleaded not guilty, and is not expected to go to trial in the case before the Nov. 5 election.
This case is one of many criminal cases that the former president faces.
